            <title>Chris Faiella Recognized for Top Verdicts &amp; Settlements of 2009</title>
            <description><![CDATA[<p><span class="mt-enclosure mt-enclosure-image" style="display: inline;"><img alt="chrisheadshot.jpg" src="http://www.missouriinjurylawyersblog.com/chrisheadshot.jpg" width="321" height="401" class="mt-image-right" style="float: right; margin: 0 0 20px 20px;" /></span></p>

<p>The law firm of <a href="http://tgfwlaw.com">Tatlow, Gump, Faiella and Wheelan, LLC</a>, of Moberly, Missouri congratulates Chris Faiella for again being recognized by Missouri Lawyers Weekly in their list of Top Verdicts & Settlements of 2009.</p>

<p>	The $2.5 million settlement was reached for the family of a Moberly woman who was killed in a head-on collision on Missouri Route 22 near Centralia, Missouri, on June 9, 2008.  The decedent had been driving to Centralia with her sister and adult daughter when the other driver, an employee of Ozark Kenworth, allegedly reached for his cell phone and swerved across the centerline and struck their vehicle.  The two sisters were declared dead at the scene, and the daughter sustained serious personal injuries.  The adult daughter, who is mentally disabled, received full care from her mother before the accident.  The case, <u>Williams, et al v. Ozark Kenworth, Inc., and Jeffrey Schuermann</u>, Case No. 08-0417-CV-W-DGK was filed in the U.S. District Court for the Western District of Missouri. </p>

            <title>Contaminated Water Supply in Central Missouri Town of Vienna</title>
            <description><![CDATA[<p>The <a href="http://yosemite.epa.gov/opa/admpress.nsf/names/r07_2010-3-3_vienna_wells_site">U.S. Environmental Protection Agency</a> recently announced its proposal to add the Vienna Wells Site in Vienna, Missouri to the federal Superfund National Priorities List.  The Vienna site consists of three public drinking wells in which a chemical known as PCE (tetrachloroethylene) has been detected.</p>

<p>PCE is a man-made liquid solvent widely used in dry cleaning and grease removal.  According to a report by <a href="http://www.connectmidmissouri.com/news/story.aspx?id=425417">KRCG News</a>, the contamination originated from an old hat factory located near the city's main well. The factory has been closed for 15 years.</p>

<p>PCE is thought to be a carcinogen and has been linked in tests in laboratory animals to cancer of the liver and kidneys.  If there is exposure to PCE, either through drinking or touching contaminated water, or by breathing contaminated air, the risk for harmful health consequences depend on a variety of factors.  These factors include the dose (how much), the duration (how long), and how the exposure occurred.</p>

            <title>Missouri Injuries On The Job</title>
            <description><![CDATA[<p>If you are injured on the job, there is worker's compensation, a Missouri state and employer-funded benefits program that compensates injured workers for medical bills, lost wages and in some cases, rehabilitative services.  Unfortunately, worker's compensation, while helpful, often leaves injured workers without full compensation.</p>

<p>Injured workers may have the right to seek money damages from people who cause their injuries through negligence, or through a defective product.  These suits may not be pursued against the injured worker's employer, as the employer provides the worker's compensation benefits and is immune from suit.  However, third parties which can include the company who defectively designed equipment or other product, or failed to put a guard or warning on the product that injured the worker, may be liable.  Another example would include a negligent driver who caused injuries to an employee who was driving his employer's vehicle.</p>

<p>Workers also have the right, under some circumstances, to sue co-employees of their employers when the co-employee injures the worker by taking an additional affirmative step that constitutes something more than mere violation of the employer's duty to provide a safe workplace.  This are of the law can be complex, and is case specific.  However, workers should know that they have rights against third parties, and potentially against co-employees that may provide compensation for pain and suffering, loss of earnings capacity, future medical bills, future lost wages, scarring and disfigurement and loss of enjoyment of life.</p>

            <title>No Workers&apos; Comp for Missouri Worker Who Falls On Ice In Parking Lot</title>
            <description><![CDATA[<p>Winter weather usually ushers in plenty of ice and snow for Missourians.  This year is no exception.  Just getting to and from your car in inclement weather can be a challenge during the winter months.  Falls on icy parking lots cause many injuries, including fractures and head injuries.</p>

<p>In 2005, the Missouri Legislature amended the Workers' Compensation Law.  Unfortunately for Missouri workers, the changes make it more difficult to receive compensation if you are injured in a fall while getting to or leaving your place of employment.  In a recent decision by the Missouri Court of Appeals, the court decided against a restaurant worker who slipped and fell on black ice in the parking lot after leaving work.  The employee injured his ankle, requiring surgical repair using a plate and seven screws.  The case, <a href="http://www.courts.mo.gov/file.jsp?id=37143"><u>Hagar v. Syberg's Westport and Treasurer of Missouri as Custodian of the Second Injury Fund</u>, No. ED93420,</a> was handed down February 23, 2010.</p>

            <title>Springfield Hospital Reports Radiation Overdose Administered to 76 Cancer Patients</title>
            <description><![CDATA[<p>The <a href="http://www.nytimes.com/2010/02/25/us/25radiation.html">New York Times reported</a> on a recent report filed by CoxHealth medical facility in Springfield, Missouri where they admitted to over-radiating 76 cancer patients during treatment.  The majority of the patients were being treated for brain cancer, and received about a 50% overdose of radiation therapy.  A hospital employee improperly calibrated the machine used to administer the radiation.</p>]]></description>

            <title>Will Are Not Forever</title>
            <description><![CDATA[<p>The Missouri Supreme Court recently decided the case of State ex. rel. Unnerstall v. Berkemeyer. This ruling upheld a statute that requires a will to be admitted to probate within one year o f death.  A decedent's estate may be administered after one year if additional assets are found, however, the statutes would treat that decedent as having died intestate (without a will) in spite of what the decedent's will may have said, had it been presented for probate within one year of the decedent's death.</p>

<p>Normally this is not a problem, however, if a will is not discovered and admitted to probate within one year of the date of death, a decedent's wishes may not be carried out. <br />

            <title>Delaware Pediatrician Charged With 103 Counts of Sexually Abusing Children</title>
            <description><![CDATA[<p>In what appears to be possibly the worst case of child sexual abuse by a physician in American history, Dr. Earl Bradley, a pediatrician formerly practicing in Lewes, Delaware, has been <a href="http://www.delawareonline.com/apps/pbcs.dll/article?AID=2010100223004">indicted on 103 counts of sexually abusing children</a> who were patients of his practice.  Since 2007, Dr. Bradley has been filming sexual acts with children in his exam rooms, some as young as 3 months old.</p>

<p>Multplie lawsuits have been filed against Dr. Bradley, and also against the Beebe Medical Center where he practiced for failure to report suspicisons of abuse to the appropriate licensing board.  According to a current investigation by the Delaware Attorney General, it appears that as far back as 2004, the Delaware Board of Medical Practice may actually have been aware of Dr. Bradley being possibly unfit to practice.  </p>]]></description>

            <title>&quot;Tort Reform&quot; is Un-American</title>
            <description><![CDATA[<p>You may or may not be familiar with the phrase "tort reform."   <a href="http://en.wikipedia.org/wiki/Tort_reform">Wikipedia defines tort reform</a> as "proposed changes in the civil justice system that would reduce tort litigation or damages."   What is "Tort?"  It is a system within our laws set up to compensate injured parties for harm done to them by someone or something else.  Limiting tort litigation doesn't necessarily sound like a bad thing, until you start to think about what tort reform really means for Americans.</p>

<p>In recent years, proponents of tort reform have focused particular attention on personal injury law, crying foul when an injured person is awarded a large verdict amount.  According to a<a href="http://correspondents.theatlantic.com/andrew_cohen/2010/02/why_tort_reform_is_anti-democratic.php"> recent article</a> by Andrew Cohen, corporations have brainwashed millions of Americans into believing that tort reform will save them from the greedy trial lawyers who are getting these big verdicts.  Cohen writes that in truth, the verdicts are decided upon by everyday people--the jurors who sat and listened to the injuries caused by a corporations' wrongdoing and voted to award a big verdict to help offset the cost of medical expenses and lost wages the claimant had suffered.  "Each time a jury awards a large sum to a plaintiff against a negligent defendant, it's a statement from jurors that the sort of conduct alleged and proven is worthy of punishment by the community."</p>

<p>Now, if you think about big corporations and what would be in their best interest to lobby for, tort reform is the perfect solution in two ways.  First, they convince millions of Americans that the trial lawyers who help them right their wrongs are the bad guy.  Then, they lobby the legislators to change the laws so that consumers have such a limited ability to recover damages that they can no longer find attorneys willing to help them try.  According to<a href="http://www.forbes.com/2008/08/08/obama-mccain-torts-biz-beltway-cz_df_0811torts.html"> Forbes</a> reporter Daniel Fisher, tort reform is "A catchall phrase for legislative measures designed to make it harder for individuals to sue businesses."  </p>

<p>Now thanks to tort reform, instead of fostering an environment of corporate responsibility and an incentive for carefulness, the American people will no longer have a level playing field to fight against big businesses.  Do you really want your elected representatives to vote away your right to recover when someone injures you?</p>]]></description>

            <title>Falls at Work--Are They Compensable Under Missouri Worker&apos;s Compensation?</title>
            <description><![CDATA[<p>Under the Missouri Worker's Compensation Act, not all falls at work are created equal.  In 2005, the Missouri Legislature significantly changed the Missouri Worker's Compensation Laws, thereby limiting claims for falls that occur at work.  Although, It has become common practice for injuries related to falls to be denied initially by the workers' compensation insurance carrier, the courts are deciding these cases based on the specific facts of each case.</p>

<p>The Missouri Supreme Court has determined: "An injury will not be deemed to arise out of employment if it merely happened to occur while working but work was not a prevailing factor and the risk involved ... is one to which the worker would have been exposed equally in normal non-employment life."  <u>Miller v. Mo. Highway & Transp. Comm'n</u>, 287 S.W.3d 671, 674 (Mo. banc 2009).</p>

<p><a href="http://molawyersmedia.com/news/missouri-lawyers-weekly/">Missouri Lawyers Weekly</a> reported a recent case from the Missouri Court of Appeals, Western District, finding that when a nurse was injured when her work shoes caused her to fall while walking, the commission properly found the injury to be compensable.  This was because the nursing shoes where a condition of her employment and she only wore the shoes to work, not outside of work. <u>Stricker v.             <title>Jefferson City Man Seriously Injured After Losing Control on Icy Roadway</title>
            <description><![CDATA[<p>Michael McKinney, 29, of Jerrefson City, Missouri was seriuosly injured in a car crash on February 16 in Moniteau County, Missouri.  The Missouri State Highway Patrol <a href="http://www.mshp.dps.mo.gov/HP68/AccidentDetailsAction?ACC_RPT_NUM=A088340F">reported</a> that McKinney was driving a 1994 Jeep on Missouri Route 5, a mile north of Fortuna when he lost control of his vehicle where the road was ice-covered.  He slid across the center line and struck a grain trailer being pulled by a 2000 Kenworth, driven by Gerard Rudolph, 40, of Versailles, Missouri.</p>

<p>McKinney was transported by Staff For Life helicopter to University of Missouri Hospital & Clinics in Columbia for treatment of his injuries.  Rudolph was not injured.</p>]]></description>

            <title>Travelers Spent $1.66M on Lobbying in the Fourth Quarter Last Year</title>
            <description><![CDATA[<p>Yesterday the Associated Press<a href="http://www.google.com/hostednews/ap/article/ALeqM5jlEZqioVFTZs_yP5OI_oW8-c8oUgD9DOQ38O1"> reported on the fourth quarter reports filed by Insurer Travelers Cos</a> last month.  Travelers lobbied Congress, the FDIC, the Federal Reserve, the SEC, the White House and the Treasury Department.</p>

<p>The filings state that they spent $1.66 million dollars lobbying for its interests on issues such as global warming, workers compensation, and consumer protection rights.  They also lobbied bankruptcy issues, asbestos legislation, and the National Insurance Consumer Protection Plan.</p>

<p>Travelers' lobbying expenses in the fourth quarter more than doubled what they spent in the third quarter.  In 2008 fourth quarter, they spent $1.43 million.<br />

            <title>Can Liability Coverage Be Stacked in Missouri Up to the Minimum Requirements of the MYFRL?</title>
            <description><![CDATA[<p>A recent decision by the Missouri Supreme Court in <a href="http://www.courts.mo.gov/file.jsp?id=36533">Karscig v. McConville and American Family Mutual Insurance Company</a>, handed down on January 12, 2010, seems to have concluded that if the liable party is insured under more than one liability policy, that in addition to the coverage provided by the primary policy covering the motor vehicle involved, additional liability policies may be stacked up to the minimum limits required by <a href="http://dor.mo.gov/mvdl/drivers/insurinfo.htm">Missouri's Motor Vehicle Financial Responsibility Law</a>.  The Missouri MVFRL requires limits of liability of $25,000.00 per person and $50,000.00 per accident.  Multiple policies should always be examined in each case to determine if the facts might provide for additional coverages available to a seriously injured party. <br />

            <title>Two Seriously Injured in Callaway County Crash</title>
            <description><![CDATA[<p>The Missouri State Highway Patrol <a href="http://www.mshp.dps.mo.gov/HP68/AccidentDetailsAction?ACC_RPT_NUM=A087537F">reported a one vehicle crash</a> that occurred in Callaway County, Missouri around 3:25 a.m. this morning.  Benjamin Bussart, 21 of Auxvasse, Missouri was driving a 1998 Chevrolet on County Road 262 near Scotland Road when he ran off the left side of the road.  The vehicle overturned and came to rest on its top.</p>

<p>Bussart's two passengers were seriously injured.  Jerry Bailey, 18 of Fulton, Missouri and Tylor Graveman, 21 of Kingdom City, Missouri were both taken by ambulance to University Hospital & Clinics in Columbia for emergency medical treatment.</p>

<p>The crash was investigated by Corporal Stegeman of the Highway Patrol.</p>]]></description>

            <title>High Levels of Carbon Monoxide Sicken 8 at a Poplar Bluff Fitness Club</title>
            <description><![CDATA[<p>Ozark Fitness, located in Poplar Bluff, Missouri was closed for several hours yesterday after <a href="http://www.semissourian.com/story/1608209.html">emergency workers discovered a dangerously high level of carbon monoxide in the air at the fitness club</a>.  At 8:07 a.m., the Poplar Bluff Fire Department responded to a call at Ozark Fitness.  Upon arrival, they used a CO meter and determined the CO level to be 800 parts per million (ppm); which is a dangerously high level of CO.</p>

<p>Firefighters evacuated the building and notified Missouri Natural Gas about the situation.  The building was closed off until the gas company determined that the pool heater had failed, causing the CO gas leak.  The gas was shut off to the building and firefighters used ventilation fans to get the CO out of the facility.</p>

<p>According to the <a href="http://www.cpsc.gov/cpscpub/pubs/466.html">Consumer Product Safety Commission</a>, mild exposure to carbon monoxide  can cause headache, fatigue, shortness of breath, nausea, and dizziness.  Higher levels of CO  The CSPC states that sustained CO concentrations above 150 to 200 ppm  will cause mental confusion, vomiting, loss of muscular coordination, loss of consciousness and death.  </p>]]></description>

            <title>Toyota Recalls Over 2 Million Vehicles Due to Gas Pedals Sticking</title>
            <description><![CDATA[<p>On February 1, 2010, <a href="http://pressroom.toyota.com/pr/tms/toyota/toyota-consumer-safety-advisory-102572.aspx">Toyota announced a recall</a> of approximately 2.3 million vehicles and suspended the sales of the eight different models.  This recall is the result of the gas pedal in the effected models sticking in the acceleration position, which could cause problems for drivers as they attempt to slow to a stop.  </p>

<p>In addition to this recall, in <a href="http://pressroom.toyota.com/pr/tms/toyota/toyota-consumer-safety-advisory-102572.aspx">November of 2009 Toyota announced a 4.2 million vehicle recall</a> of several Toyota and Lexus models for the accelerator sticking, but Toyota claims that this recall resulted from the floor mats getting in the way of the pedal and not the pedal mechanism itself.  </p>

<p>There have been numerous complaints to the <a href="http://www.nhtsa.gov/portal/site/nhtsa/template.MAXIMIZE/menuitem.f2217bee37fb302f6d7c121046108a0c/?javax.portlet.tpst=1e51531b2220b0f8ea14201046108a0c_ws_MX&javax.portlet.prp_1e51531b2220b0f8ea14201046108a0c_viewID=detail_view&itemID=279f2449f4604210VgnVCM1000002fd17898RCRD&pressReleaseYearSelect=2009">National Highway Traffic Safety Administration (NHTSA)</a> about the gas pedals and about Toyota vehicles accelerating, or the gas pedal remaining in the accelerated position, without the driver of the vehicle controlling the acceleration.  </p>

<p>Sadly, the complaints and the resulting recall did not take effect soon enough. <a href="http://www.usatoday.com/money/autos/2010-01-21-toyota-recall-gas-pedal_N.htm">U.S.A. Today reported</a>, on December 26, 2009, four people were killed in Southlake, Texas, a suburb of Dallas, when a 2008 Toyota sped off the road.  The car traveled through a fence and landed upside down in a pond. Officers on the scene found the car's floor mats in the trunk of the car, where owners had been advised to put them as part of the November, 2009 recall, as reported by the Southlake Police.  </p>

<p>If you own a Toyota vehicle, contact the nearest Toyota dealership to obtain information about the recall and to find out if your vehicle is affected or you can visit <a href="http://www.toyota.com/recall/?srchid=K610_p228906387">Toyota's Recall website</a>.  If your vehicle is included in the recall, please replace the affected parts as soon as possible.  </p>]]></description>
